The 50-State Rule on Certified Mail and Return Receipt

Last reviewed: October 2026
This page is reviewed every January and again after any state legislative session that amends a lien notice statute.
Across the 50 states, mechanics lien preliminary notices fall into three broad camps: some states require the notice to be sent by registered or certified mail, with several specifically requiring return receipt requested; others allow first-class mail or personal delivery as an alternative, and a few let the notice travel by express or overnight delivery. The four states below show the pattern (Arizona, California, Washington and Rhode Island) and their statutes are the ones lien claimants most often get wrong.
This is a general informational guide, not legal advice. Mechanics lien rules can change and may depend on the project type, property type, contract relationship, and recipient. Confirm the current text of your state’s lien statute with your construction attorney before mailing a notice.
Which States Require Preliminary Notices by Certified Mail?
There is no single nationwide mailing rule for mechanics lien preliminary notices. A subcontractor, material supplier, general contractor, construction law firm, or lien service company must check the statute that applies to the project.
Here are the four state examples covered in this guide:
| State | Mailing Rule | When Service Is Complete | Important Timing or Proof Rule |
|---|---|---|---|
| Arizona | Certified or registered mail, or first-class mail with a certificate of mailing | When deposited in the mail | Preliminary twenty day notice is due no later than 20 days after first furnishing; proof of mailing must be preserved |
| California | Registered or certified mail, express mail, or overnight delivery by an express service carrier for notices; lien claim copy may use registered, certified, or first-class mail with a certificate of mailing | When deposited with USPS or the express service carrier | Preliminary notice goes to the owner or reputed owner, direct contractor, and construction lender |
| Washington | Certified or registered mail, or personal delivery with evidence of delivery | Follow the statutory service method and preserve evidence | Notice protects work supplied after the applicable 60-day look-back, or 10 days for new single-family residence construction |
| Rhode Island | Prepaid certified mail with return receipt requested | Mailing starts the applicable look-back period | Notice of Intention to do Work or Furnish Materials must be mailed to the owner |
Many additional states name certified or registered mail in their lien notice laws. Some provide alternatives. Some distinguish between preliminary notices, notices of intent, lien claims, bond claims, and residential or commercial projects. Always verify the current statute for the state and project before sending.

What Are the Certified Mail Rules in Arizona?
Arizona’s preliminary notice is commonly called the preliminary twenty day notice.
Under A.R.S. § 33-992.01, the preliminary twenty day notice must be given no later than twenty days after the claimant first furnishes labor, professional services, materials, machinery, fixtures or tools. It must be sent to the owner or reputed owner, original contractor or reputed contractor, construction lender or reputed construction lender, and the person with whom the claimant contracted for the purchase of those items.
Arizona gives claimants mailing choices. The notice may be mailed by first-class mail with a certificate of mailing or by registered or certified mail, postage prepaid. Service is complete when the notice is deposited in the mail. A.R.S. § 33-992.01
That means Arizona does not require every preliminary twenty day notice to be sent by certified mail with return receipt requested. First-class mail with a certificate of mailing is an authorized option under the statute.
Proof is still critical. Under A.R.S. § 33-992.02, proof of mailing may be made by affidavit. If mailed by certified or registered mail, attach the receipt of certification or registration. If sent by first-class mail, attach the certificate of mailing.
Arizona also addresses a different mailing situation. Under A.R.S. § 33-1056, a stop notice served by certified mail has the same effect as personal service.
Does Arizona Require Certified Mail for the Preliminary Twenty Day Notice?
No. Arizona allows first-class mail with a certificate of mailing or registered or certified mail. The central requirement is timely service and proof of mailing. Return receipt requested is not stated as a requirement for the preliminary twenty day notice in the facts covered here.
What Are the Certified Mail Rules in California?
California’s notice rules use several delivery methods, and the correct method can depend on the document being served.
Under Civ. Code § 8110, except as otherwise provided, notice by mail under the works-of-improvement notice part must be given by registered or certified mail, express mail, or overnight delivery by an express service carrier.
Under Civ. Code § 8116, notice is complete when deposited in the mail or with the express service carrier. Under Civ. Code § 8118, proof of notice must be a declaration accompanied by USPS documentation of registered, certified, or express mail, a return receipt, delivery confirmation, or a tracking record from an express service carrier.
California preliminary notice recipients are also important. Under Civ. Code § 8200, preliminary notice must go to the owner or reputed owner, the direct contractor, and the construction lender before recording a lien claim or asserting a payment bond claim.
The mailing rule for a California preliminary notice should not be confused with the rule for serving a copy of the recorded lien claim. Under Civ. Code § 8416, a copy of the claim of mechanics lien must be served on the owner or reputed owner by registered mail, certified mail, or first-class mail with a certificate of mailing. Service is complete when the mail is deposited. Failure to properly serve the lien copy with the required Notice of Mechanics Lien renders the lien unenforceable.
Can You Use Overnight Delivery Instead of Certified Mail in California?
For notices governed by Civ. Code § 8110, California allows registered or certified mail, express mail, or overnight delivery by an express service carrier. Keep the required documentation, including the appropriate USPS or carrier record described in Civ. Code § 8118.
Because California treats preliminary notices and lien claim service separately, do not automatically apply the mailing method for one document to the other.
What Are the Certified Mail Rules in Washington?
Washington requires a written notice to the owner or reputed owner from a person furnishing professional services, materials, or equipment for improving real property.
Under RCW 60.04.031, the notice must be sent by certified or registered mail to the owner, or delivered personally with evidence of delivery. That evidence may be a receipt, a signed acknowledgment, or an affidavit of service.
Washington’s look-back rule is also essential. The notice protects lien rights only for work supplied after the date that is sixty days before the notice was mailed. For new single-family residence construction, the period is ten days.
For repair or remodel of an owner-occupied single-family residence where the claimant did not contract directly with the owner-occupier, the notice is “received” three days after mailing by certified or registered mail.
Washington is a good example of why timing and mailing records must be managed together. A notice can be prepared correctly but still create problems if it is mailed late, addressed incorrectly, or unsupported by evidence of service.
What Are the Certified Mail Rules in Rhode Island?
Rhode Island uses one of the clearest certified mail and return receipt requirements in the examples covered here.
Under R.I. Gen. Laws § 34-28-4, to preserve a lien, the claimant must mail a Notice of Intention to do Work or Furnish Materials to the owner by prepaid certified mail with return receipt requested. The look-back window runs from the mailing of the notice of intention.
Rhode Island courts apply look-back windows to what the notice protects, and those windows are counted from the mailing of the notice of intention. Because look-back calculations can affect the amount of work or materials protected by a lien, claimants should have counsel confirm the applicable period for the specific project.
Rhode Island is the important contrast in this four-state comparison: here, the statute expressly includes the return receipt requested requirement described above. Do not assume the Arizona or California mailing approach works the same way in Rhode Island.

What Counts as Proof of Mailing in Each State?
Proof requirements are not the same as proof of delivery. Certified mail tracking can show acceptance and delivery events, while a certificate of mailing may prove that an item was deposited with USPS. The statute controls what evidence is sufficient.
Here are practical recordkeeping points based on the four state rules:
- Arizona: Keep the certified or registered mail receipt, certificate of mailing, or affidavit of mailing required by A.R.S. § 33-992.02.
- California: Keep the declaration and USPS documentation, return receipt, delivery confirmation, or express carrier tracking record described in Civ. Code § 8118.
- Washington: For personal delivery, keep a receipt, signed acknowledgment, or affidavit of service under RCW 60.04.031. For certified or registered mail, retain the mailing record and tracking history.
- Rhode Island: Keep the certified mail record and return receipt requested documentation required by R.I. Gen. Laws § 34-28-4.
You can create and print USPS Certified Mail Labels online using a standard office printer or adhesive sheet. For every piece, save the letter, address, tracking number, mailing receipt, delivery confirmation, and any return receipt record together.
For additional visibility, use Certified Mail tracking and reporting to find delivery events and retrieve records when a project file, audit, dispute, or lien filing requires them.
What Does “Certified Mail, Return Receipt Requested” Actually Mean?
“Certified mail, return receipt requested” means the sender selects certified mail and asks for a receipt or delivery record showing the mailpiece was delivered according to the selected USPS return receipt service.
The phrase matters because a statute may:
- Require certified or registered mail;
- Require certified mail specifically;
- Require return receipt requested;
- Allow first-class mail with a certificate of mailing instead;
- Allow personal delivery with evidence of delivery; or
- Permit express or overnight delivery.
Do not treat return receipt requested as a universal substitute for reading the statute. It may be valuable evidence, but the legally required mailing method and proof standard vary by state and document.
Certified Mail Labels offers an Electronic Return Receipt option. The listed price is $2.91 for an electronic return receipt compared with $4.65 for the paper green card, a $1.74 saving per piece. The electronic record is returned as a PDF record of delivery.
What Happens If Your Preliminary Notice Is Late or Lost?
A late or poorly documented notice can create serious risk to lien rights. The consequences depend on the state statute, project type, recipient, and the specific error.
Before you mail, build a simple legal compliance mailing checklist:
- Confirm the correct state and project type.
- Confirm the statutory notice deadline.
- Identify every required recipient.
- Verify the owner, contractor, lender, and project addresses.
- Use the mailing method permitted by the current statute.
- Request the return receipt when the statute requires it.
- Keep the notice and every mailing record.
- Save tracking and delivery records in a searchable project file.
- Ask construction counsel to review unusual or high-value projects.
For high-volume senders, bulk Certified Mail automation can support Excel or CSV uploads, API integration, secure SFTP transfers, and USPS SCAN forms. Subcontractors and material suppliers sending hundreds of preliminary notices per project can also review the Excel batch label workflow.
If you want the mailing handled for you, use the Print & Mail full-service option. Upload a PDF letter and address list, and the service prints, inserts, applies postage, and mails the letters the same business day for orders submitted before 5:00 PM Eastern, with a notarized affidavit of mailing.
What Does Certified Mail Cost Online Compared With the Post Office?
Pricing changes, but the provided pricing context is straightforward: a 1-ounce certified mail letter with Electronic Delivery Confirmation is $7.28 online, compared with $11.02 at the Post Office counter.
Online mailing also helps you avoid repetitive counter visits, manual label preparation, and scattered proof records. You can create USPS certified mail labels, print them at your office, track the mail, and keep documentation in one workflow.
