Recently Changed Laws in Nevada

What exactly are the new laws in Nevada regarding medical debt collection notices. SB248, signed into law on June 2nd, 2021, creates new Nevada regulations for collecting medical debt. Basically, the law requires medical debt collectors to send a written notification to medical debtors before they take any action to collect their debt. They are required to send this notification 60 days before taking action.

This notification must include the following information:

•    The principal amount
•    The name of the medical debt collection agency
•    The facility name
•    The source of the medical debtor's assignment to the agency
•    The date on which the debtor received the medical treatment in question

The law also requires that medical debt collectors send debt collection notices by USPS Certified Mail.

What Other States Have Similar Laws?

New Mexico signed a similar law at the same time as Nevada. The New Mexico Patients Debt Collection Practices Act also takes action against debt collection agencies. But many other states have debt collection requirements that involve Certified Mail. For example, California and Louisiana require that medical debtors be notified of hospital liens by Certified Mail. There are similar laws in Alabama, Alaska, Colorado, Connecticut, Georgia, Illinois, Kansas, Louisiana, Maryland, Massachusetts, Minnesota, Missouri, Nevada, New Hampshire, New Mexico, New York, North Dakota, and Utah. Although the specific requirements differ, all these states require medical providers to notify recipients of a hospital lien by USPS Certified Mail.

What is Certified Mail?

Certified mail is a service provided by the United States Postal Service (USPS). It provides information about a letter or package that is sent through the mail. This information includes tracking information, delivery confirmation, the date the letter was mailed, etc. It also stores data about the mail. As of summer 2021, Nevada legally requires that medical debt collectors send their Final Demand Notices via Certified Mail. Many other states require medical providers to send similar notices by Certified Mail as well. This means that if you're a medical provider or medical debt collection agency, it's crucial that you are compliant and can send Certified Mail quickly and easily.
